  • These terms of use (« Terms of use ») apply to any visitor (the « Visitor » or « you ») or registered user (the « User » or « you ») of the website located at the following URL: www.rodilo.com (the « Website »).Access and/or any kind of use of the Website is subject to the acceptance and full compliance with the Terms of Use. Otherwise, we recommend that you do not use the Website. Specific terms and conditions may apply from time to time in addition or in replacement to Rodilo’s other services.
    We reserve the right to modify at any time and without notice all or part of these Terms of Use. The amended Terms will be notified to Visitors and Users on the Website home page. If the Visitor/User continues browsing the Website after having been informed of the said modification of the Terms of Use, this continued use will be deemed acceptance of the new version of the Terms of Use.

  • The Website is aiming at providing general information about Rodilo, the services offered by the company as well as enabling you to request more information through our contact form. The information contained in this Website does not constitute a customer-supplier exchange and may not be used otherwise than for general information purposes.
    The Website is freely accessible to anyone who has an Internet access. All costs relating to the access and use of the Website, whether costs for hardware, software or Internet access, shall be borne exclusively by the Visitors/Users. Visitors/Users are responsible for the proper functioning of their computer equipment and Internet access.
    Some sections of the Website may be reserved to Visitors which are duly identified with their email and the specific password provided by Rodilo to them.
    In order to have access to additional information regarding the services provided by Rodilo Srl, you must fill out our online Contact Form.
    When filling out this Contact Form , the User expressly undertakes to provide accurate and up-to-date personal data and to update it, through his/her personal account, in order to ensure its relevance and accuracy throughout his/her relationship with Rodilo.
    Likewise, the User agrees not to use more than one account, either under his/her own identity or that of a third party.
    The password generated by Rodilo is specific to the User, personal and confidential. You agree to keep it secret and not to disclose it in any form whatsoever. You are exclusively responsible for the storage, use and transmission of your password. You are aware of the inherent insecurity of the use of automatic memory function of login credentials that your computer system can allow, and therefore assume full responsibility for the use and possible consequences of such a function. Any use of login credentials will be deemed to have been made by the User or by a person duly authorized by the User.
    Therefore, Rodilo shall in no event be held liable for any consequences resulting from illicit use, fraud or abuse of login credentials by a third party not expressly authorized by the User to which they relate and which results from the User’s fault or negligence.
    In cases of theft or misappropriation of login credentials, the User shall immediately notify Rodilo.

  • It is forbidden to attempt or try to attempt to the security of the Website and the data of its Users, to hack, in any manner, the Website and the data of its Users notably by means of computer viruses, overload, "flooding", "mailbombing" or "crashing", to take any action that imposes an unreasonable or disproportionately large load on the infrastructure that runs the Website or to use data mining systems, robots or any other similar method for the collection and exploitation of data. It is also forbidden to reverse engineer or decompile the pages of the Website.
    Rodilo reserves the right to refuse access to the Website, unilaterally and without prior notice, to any Visitor/User not complying with the Terms of Use.

  • Following your entry into contact with Rodilo through the online Contact Form, or by using the START button providing access to specific content, Rodilo may share with you information that are to be regarded as “Confidential Information”. Such Confidential Information provide to you by Rodilo include, without being limited to, (i) all scientific and technical data, trade secrets, inventions, manufacturing processes, testing procedures, designs, drawings, diagrams, plans, specifications, know-how, formulae, computer software, reports, investigative studies, manuals and samples and any other material which includes any information relating to the discussions between you and Rodilo (the “Discussions”), (ii) any information which, although some or part of that information may not be considered commercially valuable individually, is commercially valuable in combination with other information and in the context of the Discussions; (iii) any information relating to or disclosing the existence of the potential involvement of the parties in the Discussions; (iv) commercial, financial and marketing information relating to the Discussions and/or (v) commercial, financial, marketing and other information relating to the business at hand.
    You acknowledge that all Confidential Information is disclosed to or received from Rodilo solely for the purposes of the common objective of the Discussions and for no other purpose.
    You hereby undertakes to Rodilo as follows: (i) to keep all the Confidential Information strictly confidential and not to disclose it to any third party for any purpose whatsoever without the express written authority of Rodilo, (ii) to disclose the Confidential Information only to such of your employees and professional advisers who need to access the Confidential Information and who are made aware of and comply with the terms of this clause, (iii) not to use, reproduce, transform or store any of the Confidential Information in any externally accessible computer or electronic information retrieval system or transmit it in any form or by any means whatsoever outside your usual place of business, (iv) not to use any Confidential Information for any purpose other than for the purposes of the Discussions or in any subsequent work and for no other purpose, (v) not to make copies of the Confidential Information except with the prior written consent of Rodilo and (vi) to return all documents (and copies thereof) and other materials concerning or recording the Confidential Information or any part of it or, at the option of Rodilo, expunge and destroy any of the Confidential Information from any computer, word processor or other device in the possession, power or control of the Receiving Party or their professional advisers.
    The above undertaking shall not apply to any Confidential Information which (i) is subsequently received by you from a third party not under any obligation of confidence to Rodilo, (ii) is required to be disclosed by law, (iii) is obtained by you as a result of wholly independent work which you can prove by genuine documentary evidence is not in any way based on or derived from the Confidential Information or (iv) is disclosed by you with Rodilo’s prior written approval.
    No rights of any nature are given by Rodilo to you in respect of any intellectual property rights in the Confidential Information disclosed to you.

  • We put all reasonable means at our disposal to ensure quality access to the Website and the security of the data that you provide us with via the Website, but do not assume any obligation of result in this regard. We do not guarantee the continuous operation of the Website, which may be interrupted for maintenance reasons.
    We cannot be held responsible for any other malfunction or failure of the network or servers or any other technical malfunction beyond our reasonable control that would prevent or impair access to all or part of the Website, and in case of force majeure as defined by the applicable regulations.
    Your attention is drawn to Internet limitations and constraints and to the fact that Rodilo cannot therefore guarantee the total security of data exchanges. The User is expected to take all necessary measures to protect him/herself against unauthorized intrusions within his/her information system. Furthermore, the User is informed that functioning of the Website and response times may vary according to his/her system of connection parameters and his/her Internet access service network. Rodilo assumes no responsibility in this respect.
    As a result, we can in no case be held liable, directly or indirectly, due to any malfunction of the Website caused by one or more technical features inherent to Internet or to the computer hardware or software used by the User, for any reason whatsoever.
    The materials published or provided on the Website are furnished to you "as is" and without warranties of any kind. Rodilo assumes no responsibility and does not make any warrantee that the information contained on the Website is accurate, complete, up-to-date or relevant, or that the Website contains no defects or that any defect will be remedied.

  • All elements of the Website, including its structure, its graphics, its source or object code and its content (including, but not limited to, videos, texts, graphics, images, photographs, videos, information, logos, icons, software, audio files and others, databases) are protected by intellectual property laws, and notably by copyright, trademark and patent laws.
    Rodilo reserves all rights on the Website and its content and only authorises you to visit the Website for your personal/professional needs without granting you any other rights. No material item available from the Website cannot be copied by you or displayed/ transferred by you to other parties without Rodilo’s prior consent.
    Access to and use of the Website cannot be considered as an assignment or a license agreement. As a result, you are prohibited from using the Website for purposes other than those mentioned above, including reproducing or publicly displaying, modifying, performing extraction or decompilation of all or part of the Website, including in particular its structure, its graphics, its object code or source and its content, without our prior and written express consent.
    Any breach of the foregoing is an infringement punishable by law and is likely to engage your responsibility.

  • What personal data does Rodilo process ?
    Personal data means any information relating to an identified or identifiable natural person.
    With the exception of the data mentioned in the provision "Cookies" below, we do not collect personal data other than those you voluntarily provided us with through the registration form available on the Website or by email, notably when you send us a contact request, namely your name, first name, email address and telephone number, and any other personal data you may provide us with (the « Contact details »).
    For what purposes are the personal data collected and processed by Rodilo ?
    Personal data collected by Rodilo (the « Personal Data ») will be processed by Rodilo for the following purposes:

    communicate with you and provide you with the information requested ;
    validate your registration and give you access to the services offered on the Website ;
    promote our activities (i.e. sending of newsletters about our latest news) ;
    processing of access, rectification and opposition requests, and other rights with respect to Personal Data ;
    claims and litigation management ;
    production of statistics to enhance the Website performance.

    The processing of the Personal Data is necessary for Rodilo to provide Visitors and Users with the services they requested, as well as to enable Rodilo to fulfil its legal obligations. This processing is also necessary for the legitimate interest of Rodilo as it enable it to promote its activities and improve the navigation experience on the Website.
    These purposes constitute the legal basis for the data processing carried out by Rodilo.
    Who are the data recipients ?
    Personal Data will be processed internally by duly authorized persons, within the limits of their respective attributions.
    They may also be communicated to the following third-parties:

    competent administrative and judicial authorities to enable Rodilo to fulfill its legal obligations in this regards ;
    Rodilo data processors (including IT service providers hosting the data) and external services providers (such as web designers, communication agencies, legal advisers, etc.), to the strictest extent necessary and subject to the existence of contractual guarantees to ensure the security and confidentiality of the data.

    In this context, your Personal Data may be transferred by our data processors to IT servers located in the U.S.A. provided that appropriate guarantees have been put into place to protect your Personal Data, especially by entering with the recipient(s) with a contract that contains standard data protection clauses approved by the European Commission.
    How does Rodilo ensure the security of Personal Data ?
    Personal Data collected by Rodilo will be processed by Rodilo as a data controller, in compliance with the applicable data protection legislation (i.e. EU General Data Protection Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (known as “GDPR”).
    Rodilo undertakes to implement technical and organizational security measures to ensure the protection of Personal Data against the risks associated with the use of information systems.
    Rodilo follows generally accepted security standards to help protect Visitors’ and Users’ Personal Data. However, no method of transmission over the Internet, or of electronic storage, is 100% secure. Therefore, Rodilo cannot guarantee the absolute security of the Personal Data.
    User’s Personal Data is kept until termination of his/her personal account, for whatsoever reason, as well as for the duration of the applicable prescription. Contact details are retained for the time necessary to process the request and to establish that we have responded to it. After a period of one year from the termination date of the User's personal account or our response to your request, Personal Data will be archived on a separate computer medium and accessible only if necessary by a limited number of persons specifically authorized to do so. Upon the dissolution of Rodilo, Personal Data will be purely and simply destroyed.

    What are the Visitors and Users rights ?
    In accordance with the applicable data protection legislation, and subject to the limits provided by the applicable rules, Visitors and Users are entitled to obtain, free of charge :

    access to the Personal Data pertaining to them ;
    confirmation that their Personal Data is or is not being processed ;
    information concerning at least the purposes of the processing, the categories of data to which the processing relates and the recipients or categories of recipients to whom the data are communicated ; and
    communication, in an intelligible form, of the data being processed.

    Subject to the limits provided by the applicable rules, Visitors and Users may also have inaccurate or incomplete personal data rectified, object to the collect and processing of such data, on grounds relating to their particular situation, request the erasure of all or part of the data or a restriction of the processing, and make use of their right to data portability. However, Rodilo can only respond favourably to the request for erasure within certain limits, in particular those related to its legal obligations as a data controller.
    These rights may be exercised in written, by email addressed to : squarespace@rodilo.com Rodilo reserves the right to request a scan / hard copy of your ID so that we can verify your identity before processing your request. Users can also rectify their Personal Data via their personal account.
    You can also object to the sending of newsletters at any time, either by following the instructions mentioned on the newsletter or by sending an email to the above mentioned address.

    Cookies are deleted after a period of 13 months from their date of deposit in the terminal equipment of the Visitor/User.

  • If any provision (or part of a provision) of these Terms of use is found by a court or an administrative body of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions shall remain in force.

  • These Terms of use are governed by, and construed in accordance with, the laws of Belgium.
    Subject to mandatory statutory provisions, the Courts of Belgium, of frenchspeaking role, will have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with the validity, interpretation and enforcement of the Terms of use or the access and/or use of the Website.

  • The Website is operated by Rodilo Srl, a limited liability company established and incorporated under Belgian laws, having its registered office, as of May 2023 onwards at 19 Quai sur Meuse B-4000 Liège, Belgium, registered with the Belgian Trade and Companies Register under number BE 0801.891.476 (“Rodilo” or “we”).
